§1 Scope of Application

  1. These terms and conditions apply to contracts for the rental of hostel/hotel rooms and individual hostel beds by the Three Little Pigs Hostel (hereinafter referred to as the “Hostel”) for accommodation, as well as for all services provided to or to be provided by contractual partners.
  2. These terms and conditions also apply to the rental of hostel rooms to customers who have booked through third parties. The third party is liable for this as for their own obligation, provided they have given an express and separate declaration to the Hostel.
  3. Subletting or re-letting or any other transfer of the rented rooms, as well as their use for purposes other than accommodation, requires the prior written consent of the Hostel.
  4. Terms and conditions of the customer or other contractual partner only apply if this has been agreed upon in writing beforehand.

§2 Conclusion of Contract, Partners, Liability; Statute of Limitations

  1. The contract is concluded upon the Hostel’s acceptance of the contractual partner’s application or by the contractual partner signing the check-in form. The Hostel is free to confirm the room booking via email.
  2. Contractual partners are the Hostel on one hand and the customer or other contractual partner on the other. If a third party has ordered for the customer, they are liable to the Hostel together with the customer as joint and several debtors for all obligations arising from the hostel accommodation contract and all other obligations from agreements with the Hostel, provided the Hostel has a corresponding declaration from the third party.
  3. The Hostel is liable for its obligations under the contract in accordance with statutory provisions. In areas not typical of the service, the Hostel’s liability is limited to intent and gross negligence.
  4. The statute of limitations for all claims of the customer and other contractual partners is 6 months.
  5. This limitation of liability and the six-month statute of limitations also apply in favor of the Hostel in the event of a breach of obligations.
  6. Hostel accommodation contracts for minor guests (at least 18 years old!) must also be concluded by a person with full legal capacity. The Hostel must be informed if the persons are minors or do not have full legal capacity. The stay must be paid for in full in advance. Upon acceptance of the contract, the Hostel will issue a prepayment invoice, which must be settled by bank transfer at least 5 working days before arrival.

§3 Room Provision, Arrival and Departure

  1. The contractual partner has no claim to the provision of specific rooms.
  2. Unless otherwise agreed, check-in is not possible before 3:00 PM on the day of arrival, and check-out must take place by 11:00 AM on the day of departure.
  3. On the agreed day of departure, rooms must be vacated and made available to the Hostel by 11:00 AM at the latest during the week. Thereafter, the Hostel may charge 50% of the full lodging price (list price) for the additional use of the room until 6:00 PM, and 100% after 6:00 PM, in addition to any damage incurred. The customer is free to prove to the Hostel that no damage or significantly lower damage has occurred.
  4. For a binding booking, a valid credit card number with expiration date & CVV from a credit card company accepted by the Hostel must be provided, or a prepayment must be made.
  5. The Hostel is entitled to demand a reasonable prepayment or security deposit upon conclusion of the contract or thereafter. The amount of the prepayment and the payment dates can be agreed upon in writing in the contract.
  6. Minors are not allowed to stay in dormitories, but only in private rooms. Furthermore, they must present written permission from a legal guardian including a copy of that person’s ID, at the latest upon arrival (“Travel Authorization” available as a PDF in the download area of the website).
  7. Animals are not allowed.
  8. When staying in a dormitory, the Hostel reserves the right to change rooms during the stay in exceptional cases.

§4 Services, Prices, Payment, Offsetting

  1. The Hostel is obliged to keep the number of beds booked by the contractual partner available and to provide the agreed services.
  2. The contractual partner is obliged to pay the Hostel’s applicable or agreed prices for the provision of rooms or beds and for other services used. This also applies to services and expenses incurred by the Hostel for third parties at the request of the contractual partner, as well as in the event that the contractual partner had the beds or other services ordered by third parties. All Hostel services must be paid for in cash or by credit card upon arrival.
  3. If the period between the conclusion of the contract and the fulfillment of the contract exceeds 4 months, and if the price generally charged by the Hostel for such services increases, the Hostel may increase the contractually agreed price appropriately, but by no more than 10%.
  4. Prices may also be changed by the Hostel if the contractual partner subsequently requests changes to the booked room category, the number of booked beds, the length of stay of the guests, or other services, and the Hostel agrees to this.
  5. The Hostel is entitled, for important reasons, to accommodate the guest in another hostel or guesthouse with a comparable standard and service at the contractually agreed price. The cancellation period for the guest (free of charge until 6:00 PM the day before for individual guests) remains unaffected by this.
  6. The agreed prices include the taxes and local charges applicable at the time the contract is concluded. Local charges owed by the guest themselves under the respective municipal law, such as spa tax or CityTax, are not included. In the event of a change in the statutory VAT or the introduction, change, or abolition of local charges on the subject of the service after the contract is concluded, the prices will be adjusted accordingly. For contracts with consumers, this only applies if the period between the conclusion of the contract and the fulfillment of the contract exceeds four months.
  7. Hostel invoices without a due date are payable without deduction within 10 days of receipt of the invoice. The Hostel is entitled to make accrued claims due at any time and demand immediate payment. In the event of default in payment, the dunning process will be handed over to an in-house service provider after a period of 10 days.
  8. Costs for international transfers
    1. Transfers to and from abroad: The guest is responsible for all fees and costs incurred in connection with international transfers. This includes, in particular, bank fees, currency conversion fees, and other transaction-related costs. The guest undertakes to ensure that the full amount of the invoice is received in our account without deductions.
    2. Liability for fees: Should the transfer be reduced by fees or deductions, the Three Little Pigs Hostel reserves the right to charge the difference to the guest. The guest acknowledges that all applicable fees are to be borne by them and that the company is not liable for any delays or complications in the transfer.
  9. The contractual partner can only offset or reduce a claim of the Hostel with an undisputed or legally binding claim.
  10. In the event of loss of a key, the customer bears the replacement costs in the amount of 2.00 euros.

§5 Withdrawal by the Contractual Partner (Cancellation)

  1. If a deadline for withdrawing from the contract has been agreed upon in writing between the Hostel and the customer, the customer may withdraw from the contract until then without triggering payment or damage claims by the Hostel. The customer’s right of withdrawal expires if they do not exercise their right of withdrawal in writing to the Hostel by the agreed deadline, unless there is a case of default in performance by the Hostel or an impossibility of performance for which it is responsible.
  2. Withdrawal by the contractual partner (valid for individual travelers up to max. 10 people) from the contract concluded with the Hostel is possible free of charge until 6 PM on the day before arrival (see, however, paragraph 3). Later cancellation requires the written consent of the Hostel. If this is not given, the Hostel will charge a cancellation fee of 100% of the contractually agreed lodging price for the first night. This does not apply in cases of default in performance by the Hostel or an impossibility of performance for which it is responsible.
    For Non-Ref rates or last-minute bookings, the full amount (including taxes and service fees) will be charged, which is non-refundable. This rate is non-refundable and cannot be changed or canceled. If the customer changes or cancels this booking, the customer will not receive a refund.
  3. The following cancellation rules apply to groups of 11 or more people: Groups must report the final number of guests to the Hostel at least 1 week before arrival.
    • for cancellation less than 8 weeks before arrival: 30% of the stay price
    • for cancellation less than 4 weeks before arrival: 50% of the stay price
    • for less than 2 weeks before arrival: 75% of the stay price
    • for less than 7 days before arrival: 100% of the accommodation price

    If the guest does not arrive at all or only reduces the number of people upon arrival, the Hostel is entitled to charge the full contractually agreed amount.

  4. The customer must provide proof of having canceled the booking in time and with the consent of the Hostel.
  5. The Hostel is free to flat-rate the damage incurred and to be compensated by the customer. The customer is obliged to pay the contractually agreed price for the overnight stay with or without breakfast in accordance with the cancellation conditions. The customer is free to prove that no damage occurred or that the damage incurred by the Hostel is lower than the requested flat rate.
  6. Complaints must be addressed by the guest to the Hostel immediately. In the event of a delayed complaint, the claim for rescission and reduction is forfeited.

§6 Withdrawal by the Hostel

  1. If a right of withdrawal for the contractual partner within a certain period was agreed upon in writing, the Hostel is for its part entitled to withdraw from the contract during this period if there are inquiries from other customers for the contractually booked rooms and the contractual partner does not waive their right of withdrawal upon inquiry by the Hostel.
  2. If an agreed deposit or prepayment is not made or not made on time, the Hostel is also entitled to withdraw from the contract.
  3. Furthermore, the Hostel is entitled to withdraw from the contract extraordinarily for an objectively justified reason, for example
    1. if force majeure or other circumstances for which the Hostel is not responsible make fulfillment of the contract impossible,
    2. if rooms are booked under misleading or false statements of essential facts, e.g., regarding the person of the contractual partner or the purpose,
    3. if the Hostel has reasonable cause to believe that the use of the hostel service may endanger the smooth operation of the business, the security, or the public reputation of the Hostel, without this being attributable to the Hostel’s sphere of control or organization,
    4. if there is a violation of § I paragraph 2.

    The Hostel must inform the contractual partner of the exercise of the right of withdrawal immediately. In the event of a justified withdrawal by the Hostel, the contractual partner has no claim for damages.

§7 Liability of the Hostel

  1. The Hostel is liable with the diligence of a prudent businessman. This liability is in the area not typical of the service, but limited to performance defects, damages, consequential damages, or disruptions attributable to intent or gross negligence on the part of the Hostel. Should disruptions or defects occur in the Hostel’s services, the Hostel will endeavor to provide a remedy upon knowledge or immediate complaint by the contractual partner. The contractual partner is obliged to contribute what is reasonable to remedy the disruption and keep any possible damage to a minimum.
  2. The Hostel is not liable to the guest or the contractual partner if the provision of services becomes impossible in the event of a strike or as a result of force majeure. In these cases, the Hostel will endeavor to obtain equivalent services elsewhere.
  3. The Hostel is liable to the contractual partner for items brought in according to the statutory provisions of § 702 BGB. Money and valuables up to a maximum value of 800.00 euros can be kept in the hotel safe against a receipt, in accordance with the statutory conditions for items brought in. The Hostel recommends making use of this possibility. Liability claims expire if the contractual partner does not notify the Hostel immediately after becoming aware of the loss, destruction, or damage.
  4. The storage of non-prescribed mobility aids is not permitted in rooms, hallways, emergency exits, or other public areas. Charging stations: E-scooters may only be charged at designated charging stations. Charging in rooms or public areas is prohibited. Parking regulations: E-scooters must be parked in designated parking spaces (second backyard). Liability: The hotel assumes no liability for damage or loss of e-scooters or bicycles. The customer is responsible for their own vehicles. Safety distances: E-scooters should be parked at a distance of at least one meter from fire alarms and other safety-relevant equipment. Use within the hostel: Riding e-scooters inside the hostel (e.g., in hallways or lobby areas) is not allowed. Parking of motor vehicles is not permitted.
  5. Messages, mail, and shipments of goods for guests are handled with care. The Hostel takes over the delivery, storage, and – upon request – the forwarding of the same for a fee. Claims for damages, except for gross negligence or intent, are excluded.
  6. Items left behind by the contractual partner will only be forwarded upon request, risk, and cost of the customer. The Hostel stores the items for 6 months and charges a reasonable fee for this.

§8 House Rules

  1. The house rules are part of the General Terms and Conditions. In the event of violations of the house rules, the Hostel is entitled to terminate the accommodation contract without notice. Cancellation fees in accordance with the cancellation rules will be due for any services not used as a result.
  2. Out of consideration for the residents, a ban on staying in the adjacent courtyards applies from 10:00 PM; likewise, quiet hours apply in all rooms and hallways from 10:00 PM. We ask that you only listen to music or radio with headphones, as well as videos on mobile devices. Talking out of windows is not desired in order to avoid unnecessary disturbance to residents and guests. Failure to observe quiet hours can lead to immediate expulsion from the premises.
  3. Smoking and vaping in the rooms and any handling of fire are prohibited throughout the house. In the event of a violation, an extra cleaning fee must be paid before departure. Anyone who negligently triggers the fire alarm system through cigarette smoke or other handling of fire or smoke must bear the full costs of the automatic fire department response. The management reserves the right to expel guests from the house who violate these rules and thus endanger the safety of other guests.
  4. The guest must treat the hostel facilities and the rooms with care and, in particular, avoid heavy soiling and damage. If soiling or damage that goes beyond the normal level of use is discovered even after the guest’s departure, the Hostel is entitled to subsequently charge the guest for repair costs, costs for replacement, or for cleaning.
  5. Please return borrowed towels directly to the reception upon departure. For groups of 12 or more people: On the day of departure, rooms must be left swept clean. Trash bags and brooms are available at the reception.
  6. In case of elevator problems, the house staff must be informed/called for help using the emergency call button. Damage and any technician assignments as a result of unauthorized interventions must be paid for before departure.
  7. On the day of arrival, rooms are available from 3:00 PM. Departure must take place by 11:00 AM. Luggage can be stored free of charge in the luggage room at the reception. Despite video surveillance, no liability is assumed, so valuables should please be removed from luggage and locked in a safe box. Keys are available at the reception against a deposit. We point out that we assume no liability for luggage and valuables. Please make sure to close the door correctly when leaving the room. In shared rooms, only the number of paid beds should be used, otherwise we will charge extra cleaning fees. Lockers are available in the room free of charge. Padlocks can be brought by yourself or purchased at the reception. Valuables can also be locked in a safe box (against a deposit) directly at the reception.
  8. Bringing alcoholic beverages of any kind is prohibited! The staff is authorized to enter rooms if quiet hours are disturbed and/or alcohol is consumed.
  9. Bringing illegal intoxicants and weapons is strictly prohibited and leads to immediate expulsion from the premises. In any case, the relevant authorities will be notified.
  10. For safety and hygiene reasons, it is not permitted to store food in the rooms. You are welcome to use the communal kitchen.
  11. Lost key cards will be charged at 2.00 euros, lost keys for safe boxes and locker locks at 5.00 euros and must be paid immediately.
  12. Overnight stays by non-guests are generally prohibited.

§9 Final Provisions

  1. The right to correct errors as well as printing and calculation errors is reserved.
  2. Changes or additions to the contract, the acceptance of the application, or these terms and conditions for hostel accommodation must be made in writing. Unilateral changes or additions by the contractual partner are invalid.
  3. The place of performance and payment is the registered office of the Hostel.
  4. The exclusive place of jurisdiction – also for check and bill of exchange disputes – in commercial transactions is the registered office of the Hostel, here Berlin. If a contractual partner fulfills the requirements of § 38 paragraph 1 ZPO and has no general place of jurisdiction in Germany, the place of jurisdiction is the registered office of the Hostel.
  5. German law applies.

Arriving by car

Of course, despite the great public transport links, you can also reach the Three Little Pigs Hostel by car.
Set the address “Stresemannstr. 66, 10963 Berlin (Kreuzberg)” in your GPS to reach your destination easily.

Once you arrive, you can park on either side of Stresemannstraße. There is also free parking available in the neighboring streets.

Please keep the environmental zone in mind when arriving by private car!
