5. Registration on Our Website
The data subject can register on the website or fill out contact forms by providing personal data. Which personal data is transmitted is determined by the respective form. The entered personal data is collected and stored exclusively for internal use by Three Little Pigs Hostel and for our own purposes. Three Little Pigs Hostel may arrange for transmission to one or more processors. 7. Routine Deletion and Blocking of Personal Data
The controller processes and stores personal data of the data subject only for as long as necessary to achieve the storage purpose or if this is provided for by the European legislator or other legislators in laws or regulations to which we are subject.

If the storage purpose no longer applies or if a storage period prescribed by the European legislator or another competent legislator expires, the personal data is routinely blocked or deleted in accordance with legal regulations.

8. Rights of the Data Subject
Every person affected by the processing of personal data has the following rights granted by the European legislator:

8a) Right to Confirmation
Every data subject has the right to obtain confirmation from the controller as to whether personal data concerning them is being processed. If a data subject wishes to exercise this right, they can contact an employee of Three Little Pigs Hostel at any time.

8b) Right to Access
Every data subject has the right to obtain free information at any time about the personal data stored about them and a copy of this information. Furthermore, the European legislator has granted the data subject access to the following information:

  • the purposes of processing
  • the categories of personal data being processed
  • the recipients or categories of recipients to whom the personal data has been or will be disclosed, in particular recipients in third countries or international organizations
  • if possible, the planned duration for which the personal data will be stored, or, if this is not possible, the criteria for determining this duration
  • the existence of a right to rectification or erasure of personal data concerning them or to restriction of processing by the controller or a right to object to such processing
  • the existence of a right to lodge a complaint with a supervisory authority
  • if the personal data is not collected from the data subject: all available information about the origin of the data
  • the existence of automated decision-making, including profiling, in accordance with Article 22(1) and (4) GDPR and—at least in these cases—meaningful information about the logic involved, as well as the significance and the envisaged consequences of such processing for the data subject

  • The processing is unlawful, but the data subject opposes the erasure of the personal data and requests instead the restriction of the use of the personal data.
  • The controller no longer needs the personal data for the intended purposes. However, the data subject needs it for the establishment, exercise, or defense of legal claims.
  • The data subject has objected to processing pursuant to Art. 21(1) GDPR, but it is not yet clear whether the legitimate grounds of the controller override those of the data subject.

If one of the above conditions is met and a data subject wishes to request the restriction of personal data, they can contact an employee of Three Little Pigs Hostel at any time. The employee will arrange for the restriction of processing.

8f) Right to Data Portability
Every data subject has the right to receive the personal data concerning them in a structured, commonly used, and machine-readable format from the controller. They also have the right to transmit this data to another controller without hindrance from the controller, provided that the processing is based on consent pursuant to Art. 6(1)(a) GDPR or Art. 9(2)(a) GDPR or on a contract pursuant to Art. 6(1)(b) GDPR and the processing is carried out by automated means, provided that the processing is not necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller.

Furthermore, in exercising their right to data portability pursuant to Art. 20(1) GDPR, the data subject has the right to have personal data transmitted directly from one controller to another, where technically feasible and when doing so does not adversely affect the rights and freedoms of others.

To exercise the right to data portability, the data subject can contact an employee of Three Little Pigs Hostel at any time.

8g) Right to Object
Every data subject has the right, on grounds relating to their particular situation, to object at any time to the processing of personal data concerning them which is based on Art. 6(1)(e) or (f) GDPR. This also applies to profiling based on these provisions.

In the event of an objection, Three Little Pigs Hostel will no longer process personal data unless compelling legitimate grounds for the processing are demonstrated that override the interests, rights, and freedoms of the data subject, or the processing serves the establishment, exercise, or defense of legal claims.

If Three Little Pigs Hostel processes personal data for direct marketing purposes, the data subject has the right to object at any time to the processing of personal data for the purpose of such marketing. This also applies to profiling insofar as it is related to direct marketing. If the data subject objects to Three Little Pigs Hostel processing for direct marketing purposes, the personal data will no longer be processed for these purposes.

If the decision (a) is necessary for entering into or performing a contract between the data subject and the controller or (b) is based on the data subject’s explicit consent, Three Little Pigs Hostel takes appropriate measures to safeguard the data subject’s rights and freedoms and legitimate interests, including at least the right to obtain human intervention on the part of the controller, to express their point of view, and to contest the decision.

8i) Right to Withdraw Data Protection Consent

9. Data Protection in Applications and the Application Process
Three Little Pigs Hostel collects and processes personal data of applicants to handle application processes. Processing may also be carried out electronically, particularly when an applicant submits application documents electronically. If an employment contract is concluded with an applicant, the transmitted data will be stored for the purpose of processing the employment relationship in compliance with legal regulations. If no employment contract is concluded with the applicant, the application documents will be automatically deleted two months after notification of the rejection decision, provided that no other legitimate interests of the controller prevent deletion. Other legitimate interest in this sense is, for example, an obligation to provide evidence in proceedings under the General Equal Treatment Act (AGG).

10. Legal Basis for Processing
Art. 6(1)(a) GDPR serves as the legal basis for processing operations for which we obtain consent for the processing of data for a specific purpose. If the processing of personal data is necessary for the performance of a contract to which the data subject is party, the processing is based on Art. 6(1)(b) GDPR. The same applies to processing operations necessary for carrying out pre-contractual measures. If Three Little Pigs Hostel is subject to a legal obligation that requires the processing of personal data (for example, fulfilling tax obligations), the processing is based on Art. 6(1)(c) GDPR. In rare cases, the processing of personal data may be necessary to protect the vital interests of the data subject or another natural person. This would be the case, for example, if a visitor were injured at our premises and their name, age, or other vital information had to be passed on to a hospital. Then the processing would be based on Art. 6(1)(d) GDPR. Finally, processing operations may be based on Art. 6(1)(f) GDPR. This applies to processing operations not covered by any of the legal bases mentioned here if processing is necessary to protect our legitimate interests or those of a third party. This applies provided that the interests, fundamental rights, and freedoms of the data subject do not override. This is permitted for us primarily because it was specifically mentioned by the European legislator, as a legitimate interest could be assumed if the data subject is a customer of the controller (Recital 47, sentence 2 GDPR).

11. Legitimate Interests in Processing Pursued by the Controller or a Third Party
If the processing of personal data is based on Article 6(1)(f) GDPR, our legitimate interest is to conduct our business for the well-being of all our employees and our shareholders.

12. Duration for Which Personal Data Is Stored
The respective legal retention period is the decisive criterion for the duration of storage of personal data. After the period expires, we routinely delete the corresponding data, provided we no longer need it to fulfill contracts or initiate contracts.

13. Legal, Contractual Provisions Regarding the Provision of Personal Data; Necessity for Contract Conclusion; Obligation of the Data Subject to Provide Personal Data; Possible Consequences of Non-Provision
We inform you that the provision of personal data is partly required by law or may result from contractual provisions. It may be necessary for a contract conclusion that a data subject provides us with personal data that we must also process. Failure to provide this data would mean that the contract could not be concluded.
